TERMS OF SERVICE
These are the Terms of Services for all services from Galilean Investigations unless specified and agreed upon in a separate contract. The following Terms and Services are acknowledged by the client as understood, agreed upon and accepted. The client understanding, agreement and acceptance of the following Terms of Service is also implied upon purchase of investigative services. If the client do not understand, agree and/or accept these Terms of Service, it shall be the client’s responsibility to postpone any purchase and contact Galilean Investigations for further explanation.
The client understands, agree and accept, investigators from Galilean Investigations are not peace officers, nor is Galilean Investigations a law enforcement agency. The investigations purchased from Galilean Investigations do not offer a guarantee of crime prevention.
Before any purchase of services is offered, a required acknowledgement of understanding, agreement and acceptance of these Terms of Service will be presented. Following the purchase of services, the client may download a personal copy of the Terms of Service, with Galilean Investigations’ Privacy Policy and the Summary Rights Under the Fair Credit Reporting Act (FCRA) provided the Federal Trade Commission under Galilean Investigations’ website, under the “Client Forms” tab.
Identity of Client(s) / Business Entity / Owner
For the purposes of these Terms of Services, the term “Client” is defined as an individual(s), partnership, a business entity or a business owner who explicitly and/or implicitly understood, agreed upon and accepted said Terms of Service.
The client understands, agree and accept, that due to the need of accountability between the California Bureau of Investigative Services and Galilean Investigations, before any information is released to the client, Galilean Investigations will require proof of identity from said client. If a client refuses to identify themselves after purchase of services; as a purchase is implied understanding, agreement, and acceptance of these Terms of Service, this will be deemed a breach of contract. Said client will not receive a refund.
Expectation of Investigation
The client understand, Galilean Investigations is being hired to gather facts and present said facts before the client in summary and / or detail via verbal (telephonically, virtual or in-person) or written (report or email). Galilean Investigations cannot and will not form an opinion on behalf of the client(s). The client alone determines any conclusions about credibility, opinion, and interpretation of presented facts. All investigations do not offer a guarantee of outcome based on the client’s expectations. The outcome is based on the information gathered in which the client’s budget allowed and presented before the client.
While Galilean Investigations strives to make its services all-inclusive regarding price; The client understand, agree and accept that additional expenses may incur due to unforeseen outlays required by information sources. No such excessive expense shall be imposed upon the client without their expressed consent.
Breach of contract waiver
Should a client dispute a charge through their financial institution during or after the investigation, this will constitute a breach of contract possibly resulting in, but not limited to, penalties, additional fees, collection, legal action, and/or termination of any and/or all current and future services. Penalties and additional fees include [ Fee from initial investigation + a onetime $50 processing / litigation fee + 10% interest penalty accrued monthly if initial investigative fee is not paid]. Interest percentage is 10% of initial investigative fee.
If a client has a legal and substantiated complaint about their investigation during or after said investigation; the client agrees to resolve their complaint with the owner of Galilean Investigations. If a reasonable resolution cannot be achieved, the client may seek arbitration or litigation in their residential jurisdiction. If said arbitration or litigation is resolved in the favor of Galilean Investigations, Galilean Investigations reserves the right to seek recompense for all resources used and earnings lost during the litigation.
Liability waiver
The client, upon agreement of services, identified by information provided, is contracting the services of Galilean Investigations for the purpose of conducting the purchased investigation related to the information provided by said client. Galilean Investigations believes all information provided by the client is true and correct upon substantiated assessment of information. The client agrees the information being sought is not for malicious and/or with surreptitious intent. The client accepts all liability civilly, punitively and / or criminally for all information misused illegally and/or maliciously. It is the responsibility and liability (civil / punitive) of the client alone to determine any conclusions about credibility, opinion, and interpretation of presented facts.
Background Information Discrepancy Waiver
Galilean Investigations is a consumer reporting agency. Therefore, if an Individual or Entity is disqualified from potential employment or other business due to a discrepancy within their background, the burden of proof rest on the Individual or Entity to provide Galilean Investigations proof of discrepancy. If an error does exist, Galilean Investigations will notify the reporting agency of their error and make every effort to correct said error on behalf of the Individual or Entity.
If the Individual or Entity cannot / or refuses to provide proof of error, and demands Galilean Investigation to investigate said error, the Individual or Entity must explicitly and/or implicitly understand, agree upon and accept Galilean Investigation’s Terms of Service, thus making the Individual or Entity a client, responsible for all fees required to conduct said investigation.
Implied Consent
The client understands, agree and accept the following Terms of Service upon acknowledgement and purchase of investigative services from Galilean Investigations.
Emergency Call Out Response
The client understands, agree and accept emergency call out responses requiring investigators to respond with less than 24 hour notice shall be billed to the client at $500 for a response within our service area and $800 outside of our service area within California, plus travel expenses. Upon arrival, the client shall be charged the standard investigator rate of $250 per hour in addition to the emergency call out fee.
Reports and Evidence
It is understood the client will accept the investigator’s report, either written or oral at the investigator’s option. Client also acknowledges that investigator will destroy information including but not limited to all notes, memos, electronic data, faxes, evidence, and other pertinent information at his discretion upon the completion of the investigation, or termination of this agreement, and Galilean Investigations nor the INVESTIGATOR SHALL NOT BE HELD RESPONSIBLEE FOR ANY RETENTION OF ANY EVIDENCE.
All methods and persons contacted during the investigation will be considered confidential and only be released at the discretion of the investigator. All reports are not to be shared with third parties, unless specific written permission by investigator has been granted. This includes but is not limited to information relating to Social Security Numbers, Date of Birth, DMV records, addresses, phone numbers. the client will accept facsimile, e-mail reports, and hold the investigator harmless for inadvertent disclosure during transmission and receipt by client.
No Competition
Client or their representative whether directly or indirectly agrees not to employ or engage other private investigators or agents of client without notifying the investigator. Furthermore, the client agrees to disclose to the investigator all previous investigations or surveillance relative to the subject investigation prior to this firm’s retainment. Failure of the client to comply with the above provision is grounds for termination of investigation and forfeiture of all fees / retainer fees. The client will not divulge to any person surveillance activities past or future without the investigator’s written permission, as this will constitute Breach of Contract by the client subject to, but not limited to, full compensation for surveillance(s) scheduled. The client will not willfully withhold information, which could affect investigation.
The client also agrees not to interfere with the investigator and / or the investigation. Any interference by the client directly or indirectly shall constitute a breach of contract. This action will result in the immediate termination of the case and forfeiture of all fees. The client may request for the investigation to be reinitiated with a new payment, but the director of investigations reserves the right of refusal on behalf of Galilean Investigations.
Hold Harmless
The client agrees to indemnify and hold Galilean Investigations and it’s investigators harmless from any claims that may be asserted against the investigator arising out of said investigation, including attorney’s fees in defending Galilean Investigation and it’s investigator against said claims. Client empowers the investigator to withhold any information including but not limited to reports if the client is found to have withheld information that may in the investigator’s opinion be misused by the client.
Field Contact
Clients will have no interaction with any field investigator during ongoing investigations, nor shall they be in the area of the investigation or interfere with investigator. This action will result in the immediate termination of the case and forfeiture of all fees.
Subpoena
The client acknowledges that if the investigator is required to appear as a witness BY EITHER PARTY, etc. on any case originating or related to this case, the client will be responsible for the posted applicable firm fees and retainer deposits or the investigator’s fees BEFORE the time of the scheduled appearance. The client will be charged per firm fee schedule; however, the client should anticipate fees changing from year to year. Note: All fees are calculated using one investigator. Client can anticipate, depending on circumstances of case and time frame involved, more than one investigator working the case. If a subpoena is issued and an “On Call” status is implied, normal hourly rates will be charged from the date of the subpoena until the investigator is given written confirmation of dismissal or verbal notification from client’s attorney if applicable.
The client accepts said conditions herein enumerated. This agreement includes all agreements expressed or implied, and no oral or other agreements will be valid by investigator or client, unless in writing and signed by both parties.
